Biggest mistakes made during a divorce

Celebrating 30 years in business in 2017, Smith Partnership, one of the largest firms of solicitors in the East Midlands, is often surprised by the recurring issues faced by people when going through a stressful divorce process.

Ruth Jones, Partner from the Family Law team at Smith Partnership spoke about the issues she had recently read about happening in Australia, which are commonplace in the UK as well:

“My team always wants to create a positive and open forum for families to try to come to an agreement on divorce, to provide the best possible outcome for all parties, especially when there are children involved.

“There are a number of mistakes people going through a divorce make time and time again, and I want to reassure the general public that if they get professional legal advice straight away, a lot of the pain and heart ache can be avoided.”

Here are three of the most common universal issues faced by couples:

  1. Not consulting a Lawyer - it is important that everyone understands where they stand, what they are entitled to and the range of legal options/outcomes that are open to them. A family lawyer can offer unbiased advice.
  2. Using the children as tactical weapons – in most cases, it is always in the child’s best interests to have a positive relationship with both parents. Do not try and use the children as pawns in a battle between you and your ex-partner.The two of you should communicate ideally together with the children, and then respect your children’s rights to have a positive relationship with both of you.
  3. Not being prepared to compromise and negotiate – in most cases, it is always advisable to be realistic with what you can expect to achieve in a legal process. A family lawyer can offer a number of options for you to consider, and compromise is always part of the process.
