Our family mediation service offers a confidential, structured process, guided by a trained mediator, to help both parties reach agreement on matters such as children, finances, and property. This collaborative approach allows you to remain in control of the decisions that matter most, rather than having them imposed by a court.

What is Mediation?

Mediation is a non-legal process where an independent, trained mediator helps both parties to discuss and resolve disputes arising from separation or family breakdown.

Unlike litigation, family law mediation services focus on open communication, compromise, and mutually acceptable solutions. Because mediation is often faster, less stressful and more cost-effective than court proceedings, it can be an ideal choice for resolving sensitive issues in a calmer, more collaborative way.

Mediation is confidential and takes place in a safe, neutral environment, either in person or via our online mediation service.

How Does Mediation Work?

The process begins with a Mediation Information and Assessment Meeting (MIAM). This meeting gives you the opportunity to explain your situation to the mediator, learn how the process works, and decide whether it is the right process for you.

If you and the other party agree to go ahead, structured sessions are arranged to focus on the issues in dispute. The mediator will guide discussions, ensuring both voices are heard, and will help you work towards solutions that are both fair and practical.

What are the Benefits of Mediation?

Mediation allows both parties to retain control of the decisions that are made about their future, rather than a court.

All discussions remain confidential which is a calmer and less stressful alternative to litigation.

In most cases, mediation can be more cost-effective option than taking the legal route because it involves fewer professional hours than instructing solicitors, it can often be resolved more quickly than going through court and it does not require court fees or complex legal preparation.

Privately Funded Mediation

Privately funded mediation means the sessions are a paid-for service (rather than covered by legal aid or a voucher) in which an impartial mediator helps you work toward agreement outside court. In most cases, each participant pays their own share of the mediator’s fees, though you can agree a different split between you.

One person can also choose to cover more, or all, of the cost. Your MIAM (initial assessment) is typically paid for individually unless you both decide otherwise.

Not able to make it to one of these offices? We also provide privately funded online mediation via secure video. We can offer these services over Teams or Zoom, so let us know which you would prefer in advance, plus if you have any additional requirements we need to be aware of. 

Online Mediation Services

At Smith Partnership our online mediation services allow you to take part from your home or workplace, offering the same confidentiality, professionalism, and support as our in-person sessions. This option is ideal when location, mobility, or scheduling makes attending in person difficult.

We offer remote video meetings via a number of remote connection platforms such as Zoom/Teams. Please specify which you prefer to use.

FAQs

A Mediation Information and Assessment Meeting (MIAM) is the first step in the mediation process. It allows the mediator to assess whether your case is suitable for mediation and if so, explain how mediation could help.

In many situations, especially before certain family court mediation services can be accessed, a MIAM is a legal requirement. However, continuing with mediation is voluntary.

Since 2024, attending an MIAM has been compulsory under the new Family Procedure Rules, unless you are exempt. However, mediation itself is not compulsory, if the mediator believes it unsuitable.

If the other person declines to attend, mediation cannot continue. The mediator can provide confirmation of this, which you may need if you apply to court.

Yes. MIAMs are usually attended individually, allowing you to speak openly about your situation.

The mediator’s role is to remain neutral, facilitate constructive discussion, and help both parties explore options for agreement. They do not offer legal advice or take sides.

The cost of mediation depends on the complexity of the issues and the number of sessions needed. During your MIAM, we will provide clear details of the cost, so that you can make an informed decision.

Costs may be shared or agreed between the parties. In some cases, legal aid can cover the cost of mediation.
