NHS Complaints
If you are worried that your treatment might have gone wrong, and you aren’t sure where to start, then often a formal complaint to the NHS Trust in charge of your care can be a helpful thing to do.
The NHS Complaint process exists to help patients get answers about worries they may have. It sets out how to go about complaining and also explains how the Trust will deal with your complaint.
If you write a letter of complaint then it should be sent to the Chief Executive of the Trust and state clearly that you are making an NHS Complaint. The Trust will firstly have 21 days to write back to you to acknowledge safe receipt of your letter. They then have a further 40 days to carry out a fully investigation into the circumstances of your complaint. At the end of that process they will write to you to confirm their findings. The Duty of Candour imposed on the Trust means that they have to be open and honest with you about what their investigation uncovers, which is why it can be a very helpful process.
The complaint process is usually open to patients who have had treatment in the last 12 months, or if they have come to suspect there may have been problems with their treatment within the last 12 months.
What are the limitations to making an NHS Complaint?
There is no provision for compensation to be made following a complaint, or for disciplinary procedures against individuals involved to be commenced.
