Overseas Student Debt Recovery

Recovering unpaid fees from international students can be complex, but with the right expertise it is possible to achieve consistent results while protecting relationships.

At Smith Partnership, we provide specialist overseas student debt recovery services that combine legal knowledge and international partnerships. As solicitors regulated by the Solicitors Regulation Authority (SRA), we deliver a service built on compliance and transparency.

Experienced in international student debt recovery

For decades, Smith Partnership has worked with educational establishments and accommodation providers to recover unpaid tuition, accommodation, library, sponsor, and research debts. We are proud to have maintained long-term relationships with institutions such as the University of Leeds for more than 15 years.

In total, we have pursued more than 41,000 international student accounts, recovering £37 million to date. Around 83% of this is secured directly through our UK-based team, while our trusted global network of agents allows us to extend our reach where needed. In 2023, we achieved record success levels, underlining our position as a leading provider of student debt recovery services.

Supporting universities and students

We support universities with proactive credit control services, including telephone-based contact and SMS/WhatsApp with current students to encourage timely payments. By reaching out directly, we ensure students understand their obligations and can access guidance before arrears escalate.

Our overseas student debt recovery processes

Every country presents its own challenges for international student debt recovery, so our strategies are tailored accordingly. We combine direct engagement through calls, emails, text and WhatsApp, also using trusted local agents who can act where extra steps are required.

In China, our team works directly for up to 60 days using inbound and outbound contact, before escalating to local agents if required. These agents can provide additional measures such as issuing legal letters or arranging doorstep visits where permitted, ensuring the best chance of recovery. It is worth noting that WhatsApp is not an available practice for contact with students in China.

In India, our structured process also runs for 60 days, with calls and WhatsApp messaging timed to the local timezone. Our agents can issue legal notices where needed and verify identities through local ID documentation. For higher value cases, they may recommend legal action depending on the applicable jurisdiction.

In Nigeria, our workflow includes calls, emails, and text messages. Where debts remain unresolved, we work with local agents who can pursue cases further and, if necessary, engage private investigators.

A compliant approach

All of our international student debt recovery services are carried out in line with SRA regulations. We follow GDPR requirements, including issuing a Letter Before Action before sharing data with local partners.

We work in line with educational establishments policies to deliver international student debt recovery services that are both professional and sensitive to the needs of both students and institutions. As a regulated law firm, we prioritise ethical practices, ensuring that all students are treated fairly and with respect.
